By using the Friskal app you are agreeing to be bound by the following Terms of Use and conditions contained and/or referenced herein.

I. Basic Terms

1. You must be 13 years old or older to use the Friskal Service.
2. You may not post violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive photos or other content via the Friskal Service.
3. You must not defame, stalk, bully, abuse, threaten, impersonate or intimidate people or entities and you must not post private or confidential information via the Service, including, without limited to, your or any other person’s credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.
4. You are solely responsible for your conduct and any data, text, files, information, display names, images, graphics, photos, profiles, audio and video clips, sounds, applications, links and other content or materials (collectively, “Content”) that you submit, post or display on or via the Friskal Service.
5. You agree that you will not solicit, collect or use the login credentials of other Friskal users.
6. You are responsible for keeping your password secret and secure.
7. You may not use the Friskal Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws.
8. You must not access Friskal’s API by any other means other than the Friskal application itself.
9. You must not disrupt the Friskal Service or servers or networks connected to the Service, including by transmitting any trojans, worms, viruses, spyware, malware or any other code of a destructive or disruptive nature.
10. You must not obtain any private information or data using fishing or any other similar techniques. You may not inject content or code or otherwise alter or interfere with the way any Friksal’s screen is rendered or displayed in a user’s browser or device.
11. You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.
12. You must not create or submit unsolicited email or comments or tips to any Friskal members (“Spam”).
13. You must not attempt to restrict another user from using or enjoying the Service and you must not encourage or facilitate violations of these Terms of Service or any other Friskal terms.
14. Violation of these Terms of Use may, in Friskal’s sole discretion, result in termination of your Friskal account. You understand and agree that Friskal cannot and will not be responsible for the Content posted on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Friskal, we can stop providing all or part of the Service to you.

II. General

1. Friskal may terminate your access to all or any part of the Friskal Service at any time, with or without cause, with or without notice, effective immediately.
2. Friskal may modify the Terms of use. The users of the Friskal Service will be notified, in such cases, via e-mail.
3. By linking your Friskal account with other accounts you own at third party providers such as Facebook, Google and Instagram, you agree to the terms of service of those providers. You can opt out of their terms of service at any time by unlinking your Friskal account from those providers by using the contact form available in the Friskal website.
4. Friskal application includes Google Maps features and content.  The use of Google Maps features and content is subject to the current versions of the: (1) Google Maps/Google Earth Additional Terms of Service at https://maps.google.com/help/terms_maps.html  and (2) Google Privacy Policy at https://www.google.com/policies/privacy/.
5. Friskal is not responsible for any content displayed by its users. The responsibility for the content burdens the user who uploads and posts such content. Every user has the right to report any content he has found to be abusive via the embedded reporting mechanisms or through the contact form on Friskal website, www.friskal.com.
6. Friskal reserves the right to display advertising or sponsored content or any other content that is found suitable for the welfare and good state of the service. This content may be displayed and attached to any content available, even content created by the user.  The user whose content is used for advertising reasons, may have no demands on advertising rights, payments, commissions or any other demands linked to the advertising content.

III. Proprietary Rights in Content

1. Friskal does not claim any ownership in the uploaded Content, such as photos, descriptions, videos, tips, sounds, works of authorship etc., protected by intellectual property rights and copyrights (“Content”). By displaying any content, you expressly grant Friskal a non-exclusive, transferable, sub-licensable, royalty free, worldwide license to use any such Content. In order to provide the services of Friskal it is necessary that the Content displayed by you are stored, hosted on servers, made available for retrieval, is technically duplicated, displayed and made publicly accessible and advertised. Therefore, this License grant Friskal the right to use, reproduce, re-post, re-share, publicly display, distribute, translate, and exhibit the Content, the right of recitation, performance and presentation, the right of making the Content available to the public, to broadcast it for all types of reproductions, whether for film, electronic media or online services which belong to Friskal or not. The License also includes the right to edit or otherwise change the Content in any way respecting the peculiarity of the Content. Further, the License includes the right for Friskal to fully or partially use the Content for promotional reasons and to alter photo titles, description, tags and other accompanied information accordingly.
2. By using this Service, you warrant that you are the sole owner of all rights in relation to the Content, including but not limited to copyrights and trademarks, related copyrights and that you are entitled to post or upload the Content, without infringing any such rights. You are obligated to ensure that any identifiable person imaged on a photo you post or upload has consented to such use where legally required. Uploading Content on the Friskal Service does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owing any person by reason of Content you post on or through the Friskal Services.
3. Friskal applies technical procedures for reformatting/transcoding the uploaded Content to meet the technical requirements for being displayable by the Friskal Service.
4. Friskal Service is intended to be in operation 24 hours a day and 7 days a week. Friskal reserves the right to decide the suspension or termination of access to part of and/or the entire Service, if circumstances arise beyond its control, which necessitate the suspension or termination of access, such as, indicatively, in the event of malfunctioning information systems or telecommunications networks, technical problems or for reasons of regular or emergency maintenance or in the event of other major emergencies.

Right to Revocation or Erasure

You can exercise your right of revocation or erasure at any time by deleting the Content or by terminating your account (using the contact form available on Friskal’s website). In this event, the License specified above shall terminate. The deleted content persists in backups for in order to comply with certain legal obligations and is not retrievable without a valid court order, if you delete the Content or your account.

IV. Applicable law and other terms

The aforementioned terms and conditions for the usage of the Friskal Service, as well as any amendment, alteration or distortion thereof, shall be governed by Cypriot law and European Union law and the relevant international treaties.

Any provision in the aforementioned terms that may become contradictory to the above sources of law, ceases ipso jure to apply and is removed without, in any way, affecting the validity of the remaining terms.

For any dispute that may arise from the use of this Service, the Courts of Cyprus are exclusively competent.
